Huch regret that I am now advised that the procedure of making "provisional" (repeat "provisional") appointments of Unofficial Membars of Executiva Council as agreed to in my secret telegram No. 161 was not in order since they wore aot made in respect of vacancies arising out of one or other cf the events specified in Clause 2 of the Royal Instructions. I am advised therefore that these appointments are not valid and that the four Unofficial Membera in question should be re-appointed definitively,

2. On assumption that definitive (repeat definitive) appointments of four persons mentioned in your talegrame Nos. 84 and 116, for a period of one year in each case, are desired, I hereby tranamit to you His Majesty'e Instructions for thess appointmente, limited as above mentioned,

It appears that appointment of Hazlerigg nov proposed would also not be in respect of any such vacancy. I am accordingly advised that it could not properly be made "provisionally", as you suggest. I therefore tranamit to you His Majesty's Instructions for Hazlerigg's definitive (repeat definitive) appointment for period of one year. Such an appointment cannot be made

retrospectively, but must run from date of instrument by which appointment is made.
